Wie wird man Freelancer: 5 Regeln für kugelsichere Design-Verträge

Heute mal, wenn auch allgemein gültig, speziell an die Designer: Wer schreibt, der bleibt. Das musste ich erst vor kurzem wieder feststellen, und doch ich kenne viel zu viele Designer, die sich ohne jedwede schriftliche Zusagen in die Arbeit stürzen, da rechtlicher Schriftkram natürlicherweise nicht zu ihren Passionen gehört. Selbstverständlich haben die meisten Freelancer keinen Spaß am Aufstellen von Zeitplänen, einem Pflichtenheft und all den anderen Spitzfindigkeiten, da sie sich in der Regel aus Spaß am Designen und Coden selbststädnig gemacht haben. Aber ohne jedes Schriftstück zu arbeiten kann extrem gefährlich sein! Lasst euch hier nicht abschütteln, sonst führt das früher oder später auf eurer Seite zu einem Desaster.

Dürft ihr nichtmal denken!

Wenn ihr mehr als zwei volle Tage an einem Projekt arbeiten werdet, solltet ihr wirklich etwas schriftliches festhalten. Wenn ihr keinen “ganzen” Vertrag draus machen wollt, dann schreibt ein Proposal, ein Angebot, dass euer Kunde gegenzeichnen soll. So habt ihr im Zweifelsfall wenigstens etwas.

Im Folgenden stelle ich fünf einfache Punkte vor, die ihr als Faustregel beherzigen könnt.

  1. Klar abgegrenzter Arbeitsumfang. Was genau werdet ihrem eurem Kunden liefern? Was nicht? Nehmt euch eine Minute und stellt absolut klar, für was der Kunde bezahlt. Wenn der dann kurz vor Ende des Projekts fragt, wo denn das Kontaktformular und das Gästebuch sei (das man ja unbedingt haben wolle, weil das alle hätten), könnt ihr belegen, dass dies nie Teil der Abmachung war und es dementsprechend seperat abrechnen oder auch weglassen.
  2. Eine Liste der Verantwortlichkeiten: Wirst du die Wireframes, einen Style-Guide und Benutzerhandbücher für das angeforderte CMS liefern? Wer designed das Logo für die Seite? Geht das geistige Eigentum aller erstellten Inhalte (Photoshop-Dateien etc.) nach Fertigstellung auf den Kunden über oder nur die gelieferten Grafiken, HTML- und PHP-Sourcen? Macht diese Liste, um Missverständnisse zu vermeiden.
  3. Setzt ein Limit für Revisionen: Nachdem ein scheinbar leichter Auftrag für ein kleines Ingenieursbüro zum 13. Mal nachgebessert werden muss, weiß man, wie sinnvoll dieser Tipp ist. Macht schriftlich fest, wie viele Revisionen Teil des Angebots sind (und was Revisionen sind: Wenn der Kunde plötzlich alles doch “web2.0″ haben will, ist das 1 Revision?) Setzt einen Stundensatz für zusätzliche Revisionen fest, damit der Kunde versteht, dass ihr immer gerne nacharbeitet, es aber ab einem bestimmten Punkt zusätzliches Geld kostet.
  4. Plant Verzögerungen ein: Es ist wirklich alles andere als unüblich, dass eine Website fertig und technisch abgenommen ist, aber man 2 volle Monate darauf wartet, dass der Kunde Inhalte oder Fotos liefert. Also setzt in euren Angeboten Deadlines und vor allem Zahlungsziele fest. Macht klar, dass das Fehlen von bloßem Inhalt die technische Fertigstellung der Site nicht betrifft.
  5. Zahlungsmodalitäten: Der absolute no-brainer! Anzahlung, Hälfte zu Beginn, Hälfte bei Lieferung, oder – bei größeren Sachen – feste Zahlungsziele über die Zeit verteilt.

Egal, wie spießig oder übertrieben euch manche Punkte, grade das explizite Reden über Geld, vorkommen: Denkt daran, dass ihr Rechnungen bezahlen müsst. Cash-Flow is King!
